By using Callio, you agree to these Terms of Service. Please read them carefully before using our service.
1. Service Description
Callio is an AI-powered phone assistant that makes calls on your behalf. We use artificial intelligence to conduct phone conversations with businesses based on your requests. While we strive for accuracy, AI may make mistakes, and call outcomes cannot be guaranteed. You agree not to use Callio for any purpose that is not permitted by law.
Calls may be recorded, transcribed, and analyzed for quality assurance, to generate transcripts and summaries, to provide the service, and to maintain safety. Where required by law, Callio may disclose that the call is being made by an AI assistant and/or that the call may be recorded or transcribed. By using the service, you consent to this recording and authorize us to make calls on your behalf. You agree not to use Callio to record, transcribe, or monitor any call where doing so would be unlawful.
2. Account Requirements
To use Callio, you must:
- Be at least 13 years old (if under 18, your parent or guardian must agree to these Terms)
- Provide accurate information (name, email, phone number)
- Keep your account credentials secure
3. Subscription & Billing
Free Plan
- 3 free calls when you sign up (one-time grant, no monthly reset)
Premium Plan
- $4.99 for the first month (promotional rate)
- $9.99/month thereafter (standard rate)
Cancellation
You may cancel anytime. You'll retain access until your current billing period ends. For iOS subscriptions, cancellation is managed through Apple. For Android and Web subscriptions, cancellation is managed in Settings > Subscription inside the app.
If you purchase a subscription through the Apple App Store, billing, cancellation, and refunds are handled by Apple and are subject to Apple's terms and refund policies. We do not provide refunds for partial billing periods except where required by law or platform policy.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
4. PROHIBITED USES
You may NOT use Callio for the following purposes. Violations may result in immediate account termination:
- Emergency services (911, suicide hotlines, crisis centers)
- Financial transactions (banking, transfers, payments)
- Medical information (symptoms, diagnoses, prescriptions, test results, or health conditions - appointment scheduling only is allowed)
- Legal matters (attorneys, courts, legal advice)
- Government ID information (SSN, passport, license)
- Telemarketing, robocalling, spam, lead generation, debt collection, political campaigning, or unsolicited promotional calls
- Harassment, fraud, impersonation, or illegal activities
We actively monitor for prohibited uses. Violations may result in immediate and permanent account termination without refund.
5. Call Outcomes & Billing
How calls are counted toward your usage:
Billable (counts toward usage):
- Succeeded - Call achieved your goal completely
- Completed - Call worked but didn't fully achieve goal
Non-billable (doesn't count):
- Partial - More information needed from you
- Failed - Technical issues, no answer, wrong number
6. User Responsibilities
- Provide accurate information for calls
- Review call plans before confirming
- Verify call results — reservations, bookings, prices, availability, and other information returned by Callio — before acting on them
- Use the service only for lawful purposes
- Not misrepresent your identity or intentions
7. Intellectual Property
Callio, including its AI technology, design, and content, is protected by intellectual property laws. You may not copy, modify, or reverse-engineer any part of our service. You retain ownership of the content you submit, and we use it only to provide and improve the Service for you.
8. Disclaimer of Warranties
Callio is provided "as is" without warranties of any kind. We don't promise the service will be uninterrupted or error-free, and we can't guarantee that AI responses will be accurate. To the extent allowed by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the extent allowed by law, Callio is not responsible for: call outcomes or how a business responds, missed reservations or appointments, AI errors or misunderstandings, or any indirect, incidental, special, or consequential losses (including lost profits). Our total responsibility is limited to the fees you paid us in the 12 months before the claim.
10. Indemnification
You agree to indemnify and hold harmless Callio, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: your use of the service, your violation of these Terms, your violation of any third-party rights, or any calls made on your behalf.
11. Termination
Either party may terminate at any time:
- You may delete your account in Settings > Data Management
- We may terminate accounts that violate these terms
You do not need to contact support to delete your account. If you have trouble deleting your account or have questions, you may contact support@callio-app.com.
12. Dispute Resolution
Any disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules, except for claims that may be brought in small claims court. You waive the right to participate in class actions or class arbitrations. This agreement is governed by the laws of the State of California, without regard to conflict of law principles.
13. App Store Terms
If you downloaded Callio from the Apple App Store, you also agree to Apple's terms of service. Apple is a third-party beneficiary of these Terms and may enforce them against you. In-app purchases are subject to the App Store's refund policy.
14. General Provisions
These Terms constitute the entire agreement between you and Callio. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. We may assign these Terms; you may not assign them without our consent. We may modify these Terms with 30 days' notice; continued use after changes constitutes acceptance.
